GRITFIT.AI Copyright Infringement Policy (Safe Harbor Compliance)

Designated Agent & Notice Submission: GRITFIT.AI designates a single registered DMCA agent to receive all copyright takedown notices (e.g. copyright@gritfit-ai.com). We will only process notices sent to this agent in writing. This meets 17 U.S.C. §512(c) requirements to post an agent’s contact publicly. Notice senders must include all required information: identification of the copyrighted work, identification of the infringing material (e.g. URLs or location), the sender’s contact details, a good-faith statement that the use is unauthorized, and a statement of accuracy under penalty of perjury, plus the sender’s signature. These elements are mandatory for a valid DMCA notice; failure to include them may invalidate the notice and expose the sender to liability (including damages and fees under 17 U.S.C. §512(f)). Upon receiving a compliant notice, GRITFIT.AI will act expeditiously to remove or disable access to the infringing content, as required by UK/EU safe-harbor law (which mandates prompt removal once knowledge is obtained).

Counter-Notice Procedure: If content you posted is removed for an alleged infringement, you may submit a formal counter-notice. The counter-notice must be in writing and include: (i) your full contact information (name, address, telephone); (ii) identification of the material removed and its original location; (iii) a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification; (iv) a statement that you consent to the jurisdiction of the U.S. federal court in your district (or any court where GRITFIT.AI may be found); and (v) your signature. These requirements mirror 17 U.S.C. §512(g) and ensure fairness in the notice-and-takedown process. No informal appeals or social-media messages will be considered – only a proper written counter-notice meeting these criteria is valid. If we receive a valid counter-notice, we will restore the material within 10–14 business days unless the original complainant obtains a court order.

Repeat Infringer Policy & Penalties: Consistent with 17 U.S.C. §512(i), GRITFIT.AI enforces a strict repeat-infringer policy. Users who repeatedly upload copyrighted content without authorization will have their accounts suspended or terminated. Our enforcement is graduated: first offense leads to content removal and a warning; further offenses trigger temporary suspension and then permanent ban upon repeated infringement. Coaches and content creators who monetise on GRITFIT.AI face even stricter consequences: repeated or egregious violations will result in immediate suspension of monetization, termination of the coaching contract, and forfeiture of any unlawful earnings. (We do not impose arbitrary per-use fines, as those are difficult to enforce; instead, we reserve the right to seek any damages or costs allowed by law.)

Indemnification and Liability: By using GRITFIT.AI, you warrant that all uploaded content is either your original work or properly licensed. You agree to indemnify and hold GRITFIT.AI harmless from any losses, damages, costs or legal fees arising from your breach of this policy or any infringement of third-party rights. Notably, knowingly submitting a false or bad-faith takedown notice (or counter-notice) is prohibited; under 17 U.S.C. §512(f), any person who material­ly misrepresents an infringement can be held liable for the other party’s damages, costs, and attorneys’ fees.

Governing Law and Jurisdiction: This policy is governed by the laws of England and Wales. However, to maintain our safe-harbor protections in the U.S., we incorporate DMCA notice-and-takedown procedures and jurisdiction clauses as required by U.S. law. Specifically, a user submitting a counter-notice agrees to consent to U.S. federal court jurisdiction as outlined in 17 U.S.C. §512(g)(3). This hybrid approach ensures enforceability both in the UK and under DMCA standards.

Acceptance of Terms: By signing up for and using GRITFIT.AI, all users agree to abide by this Copyright Infringement Policy. Any violation-such as unauthorised posting of copyrighted routines or misuse of the takedown process-will trigger the remedies described above. In egregious cases, users may be held responsible for GRITFIT.AI’s enforcement costs and any applicable damages.
