These Uploads & Content Terms govern any content (including, but not limited to, training videos, images, or other workout footage) that you upload to the GRITFIT-AI platform (“GRITFIT-AI” or the “Platform”). By uploading content, you (“User” or “you”) agree to these terms. These terms are in addition to and work alongside our general Terms of Service, Privacy Policy, and Health Disclaimer. They are intended to protect GRITFIT-AI and its owners from all liability arising from user-uploaded content.

1. Purpose of Content Uploads

GRITFIT-AI allows users to upload content such as personal training videos or images solely for the purpose of receiving AI-powered form analysis and workout feedback. You agree not to use the content upload feature for any purposes other than obtaining personal training feedback through the Platform. GRITFIT-AI does not claim ownership of your uploaded content; you remain the owner of all intellectual property rights in the content you upload. However, by uploading, you grant us permission to use that content strictly as outlined in these terms.

1. Acceptable Content and Prohibited Material

When uploading any content, you must ensure it complies with the following requirements and does not contain Prohibited Material. You are solely responsible for all content you upload and for any consequences arising from your uploads. You represent and warrant that your content complies with these Terms and all applicable laws. In particular, you must NOT upload any content that:

• Contains Personal Data of Others: No content should include personally identifying information about any other individual without that person’s explicit consent. You must not upload content that includes or features any minor (anyone under 18), whether identifiable or not. This includes children appearing in the background. If a minor appears in your footage, do not upload it.
• Is Offensive, Defamatory, or Illegal: Content that is offensive, obscene, harassing, hateful, or defamatory towards any person is strictly prohibited. Likewise, you must not upload any violent, graphic, or otherwise unlawful material, or any content that promotes illegal activity. All content must comply with applicable laws and not breach any duty or legal right owed to any person.
• Infringes Copyright or Others’ Rights: You may only upload content that you have the right to upload and share. Do not upload any material that infringes or violates someone else’s copyright, trademark, privacy, publicity or other rights. Copyrighted videos, images, or music that you do not own or have permission to use are not allowed. You must also not upload any third-party content (including logos or trademarks) without the owner’s consent.
• Is Misleading or Deceptive: All content must be truthful and authentic to the best of your knowledge. You must not upload misleading or fraudulent content, such as fake injuries, impersonations of others, altered or doctored videos, or any content that misrepresents your identity or the subject matter. Deceptive content (including deepfakes or staged scenarios meant to mislead) is prohibited.

GRITFIT-AI reserves the right to determine, in its sole discretion, whether any uploaded content violates the above standards or is otherwise objectionable. Violation of these rules may result in content removal or account suspension as described below.

1. Content Ownership and Limited Licence to GRITFIT-AI

You retain ownership of all content you upload to the Platform. Nothing in these terms’ transfers ownership of your content to us. By uploading content, however, you grant GRITFIT-AI and its service providers a limited, worldwide, non-exclusive, royalty-free licence to use, copy, store, process, and display your content solely for the purpose of providing you with the Platform’s AI-powered analysis and feedback services. This means we have your permission to load your videos/images into our systems, analyse them, and generate feedback for you. This licence is granted only to the extent necessary to deliver the service you have requested and to operate and improve our platform’s functionality. It is not a transfer of ownership, and except for this limited licence, you retain all rights to your content.

No Public Distribution: GRITFIT-AI will not publish, share, or redistribute your uploaded content to other users or to the public without your consent. Your content remains private to your account (except as may be necessary to provide the service, such as processing by our AI or cloud storage providers). We do not use your content for any marketing or commercial purposes outside the scope of providing you with feedback. For example, we will not feature your training videos on our site or feed them to other platforms without your permission.

Storage and Privacy: You acknowledge that uploaded content may be stored on GRITFIT-AI’s infrastructure, including secure third-party cloud services (for example, on Google Firebase or similar cloud storage). All such storage and processing of content (including any personal data contained in your videos or images) is subject to and will be handled in accordance with our Privacy Policy. We employ industry-standard security measures to protect your data; however, you understand that no system is perfectly secure. You are responsible for keeping backup copies of your content. GRITFIT-AI is not responsible for any loss or corruption of content you upload, and we do not guarantee that your content will be retained on the Platform. Content that violates these terms or that is no longer needed for providing the service may be deleted from our systems. Please refer to our Privacy Policy for details on how we safeguard and may delete personal data.

1. Content Monitoring and Enforcement

No Active Moderation: GRITFIT-AI does not pre-screen, monitor, or actively moderate user-uploaded content in real time. We do not verify the accuracy, quality, or integrity of the content you upload at the moment of upload. As a result, you submit content at your own risk, and you are solely responsible for it. GRITFIT-AI makes no representations or warranties regarding any content uploaded by users, and is not responsible for the context, accuracy, or validity of user content. Any opinions, advice, or information presented in the content belong to the user who provided it, not to GRITFIT-AI, and we do not endorse any user-provided material or its truthfulness.

User Reporting: While we do not actively monitor all content, if you become aware of content that you believe violates these Uploads & Content Terms or any law, you may report it to us through the designated feedback/reporting channels. We will review such reports and take action as appropriate at our discretion.

Removal & Suspension Rights: GRITFIT-AI reserves the right (but has no obligation) to review, screen, or analyse any user-uploaded content and to remove or disable any content that, in our judgment, violates these terms or applicable law. We also reserve the right to suspend or terminate your account (or restrict your ability to use the content upload features) without prior notice if you breach these terms or if your uploaded content is deemed prohibited or unlawful. Such enforcement actions may include, for example, removing or blocking access to specific videos/images or, in serious cases or repeat violations, disabling your account. GRITFIT-AI shall not be liable for any consequences of removing your content or suspending your account due to your violation of these terms. We may also cooperate with law enforcement or third-party rights holders by disclosing your identity or content information if legally required and appropriate in the event of serious violations (for instance, if your content is illegal or infringes someone’s rights).

1. Feedback is Informational Only (No Professional Advice)

Any analysis, feedback, suggestions, or information provided by GRITFIT-AI as a result of your uploaded content is intended for general informational and educational purposes only. This feedback is not professional advice and should not be considered medical, clinical, physiotherapy, or biomechanical advice. GRITFIT-AI is not a licensed medical or fitness professional, and the Platform’s feedback is not a substitute for professional advice or guidance from certified trainers, physiotherapists, doctors, or other qualified experts. You should always consult a qualified healthcare or fitness professional before making any changes to your exercise regimen, especially if you have health concerns or injuries.

No Guarantee of Accuracy or Outcome: While we strive to provide useful and accurate form analysis, GRITFIT-AI does not guarantee that the feedback or suggestions provided will be correct, exhaustive, or suitable for your particular needs. All feedback and analysis is generated by AI algorithms and is based on the content you upload; as such, it may sometimes be incomplete or may not fully account for your personal circumstances. Use of the Platform’s feedback is at your own discretion and risk. You agree that GRITFIT-AI and its owners shall not be liable for any injury, harm, or damages that may result from your reliance on or use of the feedback provided. The feedback does not establish any doctor-patient or trainer-client relationship, and you remain responsible for how you implement any guidance received.

1. User Representations and Warranties

By uploading content to GRITFIT-AI, you represent and warrant that:

• You Have Rights to the Content: You either are the sole owner of the content (and all intellectual property rights in it), or you have obtained all necessary permissions, rights, licences, and consents from the relevant owners to upload the content and to allow GRITFIT-AI to use it for the Service as described . In other words, you may only upload content that you have the legal right to upload and share. If the content depicts any third party (for example, if someone else appears in your video), or includes someone else’s personal data, you have obtained that person’s consent to the content being uploaded and used on the Platform.
• No Violation of Laws or Rights: You’re uploading and use of the content will not violate any law or regulation, and will not infringe the rights (including intellectual property, privacy, publicity, or confidentiality rights) of any other person or entity . The content is not subject to any confidentiality obligations that would prevent its use under these terms, and you have ensured it does not contain any prohibited material as outlined above.
• Content is Accurate and Genuine: To the best of your knowledge, any factual information in your content is accurate and not misleading, and any opinions expressed are genuinely held. You are not intentionally uploading false, manipulated, or deceptive content.
• Age and Capacity: You are of legal age and competent to agree to these terms, or you have obtained any necessary parental/guardian consent if you are a minor as per our Terms of Service age requirements.

If you breach any of the above warranties, you may be subject to consequences including removal of content and suspension of your account, and you may also face legal liability for such breach. You agree to cooperate with GRITFIT-AI in resolving any disputes or investigations arising from your content (for example, if a copyright holder reports that your uploaded video infringes their rights, you will provide proof of your rights or consents as reasonably requested).

1. Liability and Indemnification

Platform Liability Waiver: To the fullest extent permissible under applicable law, GRITFIT-AI and its owners, affiliates, employees, and agents shall not be liable for any claims, damages, or losses arising out of or relating to your uploaded content or any use of the Platform’s analysis/feedback. This includes, without limitation, any liability for errors, omissions, defamatory or unlawful content, infringement, privacy violations, or any harm or loss that results from user-uploaded content or from your reliance on feedback. GRITFIT-AI provides the service (including content storage and AI feedback) on an “as is” and “as available” basis without warranties of any kind, except as explicitly required by law. You acknowledge that uploading content and using the feedback are done at your own risk, and you assume all responsibility for any outcomes.

User Indemnity: You agree to indemnify, defend, and hold harmless GRITFIT-AI and its owners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) that arise from: (a) your content uploads, including any allegation that content you uploaded is illegal, offensive, or infringes a third party’s rights; or (b) your breach of these terms . This means that if any third party (for example, a copyright owner, a person appearing in a video, or any other party) brings a claim against GRITFIT-AI related to your content or your conduct, you will be responsible for all consequences, including reimbursing us for any losses or expenses incurred. We reserve the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate fully with us in such cases.

Limitation: Nothing in these Uploads & Content Terms shall operate to exclude or limit any liability that cannot be legally excluded or limited under applicable law – for example, liability for death or personal injury caused by negligence, or for our fraud or fraudulent misrepresentation, or other non-excludable statutory liabilities. However, to the extent that the law allows, any non-mandatory or implied warranties or duties are hereby excluded. In any event, under no circumstances will GRITFIT-AI be liable to you for any indirect or consequential losses (such as loss of profit, loss of data, or damage to reputation) arising from your use of the Platform or content uploads, and any direct liability shall be limited as provided in the general Terms of Service or applicable law.

1. Relationship to Other Policies

These Uploads & Content Terms form a part of the overall agreement between you and GRITFIT-AI regarding use of our services. They supplement our general Terms of Service, Privacy Policy, and Health Disclaimer. By uploading content, you confirm that you have read and agree to all of these policies. If there is any conflict between these Uploads & Content Terms and our general Terms of Service with respect to user-uploaded content, these Uploads & Content Terms will prevail in governing how content is handled (unless otherwise stated in a specific provision).

All other aspects of your use of GRITFIT-AI not expressly covered here are subject to the general Terms of Service. For matters of data protection and privacy (including how we collect and use any personal data in your content), please refer to our Privacy Policy. By using the GRITFIT-AI Platform and uploading any content, you acknowledge and agree to these Uploads & Content Terms. If you do not agree with these terms, you must refrain from uploading any content to our Platform. We encourage you to retain a copy of these terms for your records. We may update these Uploads & Content Terms from time to time; significant changes will be communicated or indicated by a revised effective date. Continued use of the Platform’s upload features after any changes constitutes acceptance of the updated terms.
